Trading Terms and
Conditions – International

Effective from 1 APRIL 2024


The Purchase Terms and Conditions below apply to all transactions with ICS. By placing the order with ICS, the customer accepts these Terms and Conditions.

1. Prices
For current pricing and any applicable discounts, please refer to our system.
Please note that ICS reserves the right to adjust prices without notice.
All prices are exclusive of VAT and DDP for every country.

2. Orders and Payment
Once an order has been submitted, it cannot be reduced. Only additional items can be added.
The terms and conditions specified when the order is submitted are effective immediately.
Payment must be made within 5 days of receiving the PI.

3. Freight Forwarding
ICS can arrange freight forwarding for you (service included). Any prepaid freight costs will be added to your invoice based on carrier rates. Please note this is a deviation from the standard CPT incoterm, where freight costs typically fall on the seller.
You can choose to use your own freight forwarder. In this case, prices are exclusive of VAT and EXW (Ex Works) Nuth, Netherlands. This means full responsibility for arranging transport falls on you, and ownership of the goods transfers to you upon leaving our warehouse.

(A) Delivery:
ICS will deliver your goods within 3 business days after receiving full payment.

4. Insurance
ICS’ freight forwarding service does not include insurance for your goods.
Under the CPT incoterm (used in our pricing), you assume all risk for the goods once they are handed over to the first carrier at our warehouse. This includes the responsibility to insure your shipment.
ICS is not liable for any loss or damage to goods during transport.

5. Complains

A) Reporting Issues:
Inspect your order upon arrival. Report any missing items or damaged goods immediately to your Sales Representative.
For lost shipments, contact your Sales Representative as soon as possible.
If ICS or the freight forwarder confirms lost or damaged goods, you should immediately contact your insurance company to file a claim.

6. Returns
Do not return items to ICS without contacting and discussing them with ICS, otherwise, the package will not be accepted.
If the product you receive appears to be faulty, don't panic.
First, read the manual and watch some YouTube videos of the product to make sure you are using it correctly. We often have customers who return products thinking they are faulty, but it turns out that they are simply being used incorrectly and are in perfect working order.
Returns and exchanges take a lot of time, so if we can help you solve the problem at home, we would prefer to do so that you can start enjoying your purchase right away.
If you encounter a problem with the product you purchased, please do the following:


(A) Read the product manual to make sure you are using it correctly.

(B) Take photos or short videos of the problem and email them to Infoeu@icsbb.com
We will work with you to resolve the issue. Usually, it's just a matter of figuring out how to use the product correctly. Or, if there is a problem with a part that can be easily replaced, we will send it to you.
Returning the product and repair/replacement will take longer, so we will try to work with you to resolve the issue.
If our attempts to resolve the issue remotely do not work, our customer service team will contact you to arrange for you to return the product to us. Please do not return the product without first contacting us.
We only accept returns for the wrong product delivered and manufacturing faulty products based on 14 days against the invoice date. Be sure to include your invoice number and the name of the Sales Representative you worked with on the return shipment. We may return shipments without this information.
Use the original packaging if possible. This is the ideal way to return your product as it's already sized and designed for protection.
If the original packaging is unavailable, use a sturdy cardboard box. Make sure the box is large enough to hold the original product packaging with some extra space for cushioning.
Include cushioning materials. Bubble wrap, packing peanuts, or air pillows can help prevent damage during transit.
This return policy excludes specially ordered products and campaign goods. All returns must be sent to the ICS-EU warehouse service department in the Netherlands.

7. Warranty
ICS offers exchanges or repairs for new products with manufacturing defects, typically for 6 months from the invoice date. However, specific exceptions may apply based on the terms below.

A) Exchange Eligibility:
The product must be resold by the retailer to the end-user within 1 year of ICS’ invoice date.
The product should be “new".
The product must be returned in its original packaging.


8. Repair
(A) To ensure a smooth repair process, please follow these guidelines:
 Include a completed service form with each returned repair item. Missing forms will incur a €10 fee and an additional charge for time spent diagnosing the issue.
 Attach a copy of your sales receipt showing the purchase date from the retailer.
 Products must be in original condition with no disassembly attempts. This ensures proper diagnosis and repair.

(B) Warranty coverage excludes:
 Movable and wearing parts like springs and seals.
 Damage caused by BBs/pellets or reused BBs/pellets.

(C) Repair Costs:
 Repairs are subject to a minimum €14 fee and an hourly rate of €55 (excluding VAT).

(D) User-Related Faults:
ICS will not replace new products with user-induced damage.
Examples include:
 Drops or physical impact.
 Improper magazine insertion/removal.
 Lithium battery fire damage.
 User disassembly.

(E) Return Shipping:
 You are responsible for covering the shipping cost of ICS’ service in the Netherlands.

(F) Repaired Product Delivery:
 Repaired products will be shipped back to your retailer/wholesaler on their next order or within 28 business days of receiving your item. ICS will cover this return shipping cost.
 If the repair exceeds 28 business days, you may be eligible for a replacement or refund.
 If your warranty claim is denied, you may be responsible for return shipping and repair costs.

(G) Important Note:
 All repairs must be sent directly to the ICS EU warehouse service department in the Netherlands with a completed service form (one per repair).

9. Refunds
We understand that sometimes you might want to return your purchase for a refund, and the reasons may vary. We allow refunds in most situations but keep in mind there is a restocking fee. Please consider the following scenarios and the associated restocking fees.

Products that have been used or modified cannot be returned.

Returned products must be in brand-new condition with all original packaging and manuals.
Missing items can incur up to a 60% restocking fee, or denial for return.

10. Bookable Item
Some products listed as "Preorder Items" may have limited stock or
may not be readily available.If you order this type of item that is out of stock or if you order a large quantity, expect a longer delivery time.
Delivery times the items will vary depending on the specific product.

11. Reservations
We reserve the right to update our price lists and these Trading Terms and Conditions at any time without notice.
We may also reserve products that are currently out of stock and discontinue products entirely.
We strive to provide accurate information, but we cannot be held responsible for any printing errors in our Terms and Conditions, price lists, or catalogs.


12. Important Legal Information
Age Restrictions: In many countries, Airsoft devices are regulated like firearms. This means they can only be sold to customers over 18.
Dealer Responsibility: As a seller, we are required to comply with all local laws related to these products.
Safe Use: We encourage all customers to learn about the safe and responsible use of Airsoft devices and related accessories.

13. Intellectual Property
ICS owns a wide range of intellectual property rights (IP) including trademarks, designs, and patents. We also hold licenses from real firearm manufacturers to use their IP in our Airsoft.
By placing an order with ICS, you agree to respect these intellectual property rights. This includes refraining from counterfeiting our products or those of our licensed partners. ICS reserves the right to stop doing business with anyone who violates these rights.

14. Limitation of Liability
Our maximum liability for any claim will not exceed the invoiced value of the products sold.
ICS will not be responsible for financial losses, lost profits, or other indirect losses resulting from your orders. This includes indirect losses caused by defective goods, product liability, or delays in shipment.


15. Right to request Credit Card information
We can only ship orders to the cardholder's billing address for credit card purchases.
To ensure transaction security, ICS may request additional information for verification.
We reserve the right to share relevant customer information with VISA/MASTERCARD for fraud prevention purposes if required by these payment networks.

16. Governing Law and Dispute Resolution
This agreement and any disputes arising from it will be governed by and interpreted under the laws of the Netherlands.
Any disputes arising from this agreement will be brought before the courts of the Netherlands.

17. Other
ICS reserves the right to change these terms and conditions at any time.
